Understanding Divorce

If you are considering divorce there are a number of things you need to understand about divorce law in Texas

To begin the divorce proceedings one must file a Petition for Divorce.  Once this is complete, you and your spouse have the option of mediation or trial.  In the case of an amicable dissolution of marriage, mediation is your best option.  In the case of mediation, you and your spouse will come to an agreement on: alimony (maintenance), property division, debt division, child support, custody, and visitation rights.  Once these things have been agreed upon you will be granted a Decree of Divorce.  While this may sound like a simple process, it can often take months for divorcing spouses to reach a final agreement on said points.

In the event that you and your spouse cannot settle your divorce, outside of court, you will have to go to trial.  This is generally more costly and emotionally draining but is often necessary in the case of domestic violence, adultery or other emotionally charged issues.
