Driving While Intoxicated (DWI)

Driving while intoxicated (DWI), driving under the influence (DUI), operating under the influence (OUI), and even operating a motor vehicle intoxicated (OMVI)—no matter what they call it, you do not want to have anything to do with it. Driving while intoxicated is one of the least negotiable criminal offenses.

Zero tolerance is what you should expect from your local prosecuting attorney and plea bargaining is the exception, not the rule in DWI cases. DWI puts you in a very difficult legal position. Do not look for a break or for sympathy. Look for an experienced DWI law firm. Call the Law Office of Dale A. Burrows, P.C., who has helped clients get chargers dropped with their criminal defense case. You can count on them to zealously represent you in your case.

The truth about the field sobriety test

Unusual driving behavior is not necessarily illegal, but police officers often interpret it as cause to pull you over.  Pulling over to answer a police officer's questions can put nervousness and worry into the mind of anyone.  After any instance of unusual driving, you are at a disadvantage from the start.  And you may not stand with one foot suspended six inches off the ground for long. You may not recite the alphabet backwards perfectly on your best day. And if the police officer lacks proper field sobriety test training, your nervousness may cause you to be at a greater disadvantage that results in your arrest.

Arrest and more testing

After pulling you over, putting you through the field sobriety test, and arresting you, the police must test your breath or blood to verify the alcohol content in your blood within two hours. This test is called the blood alcohol concentration test (BAC). The attorneys of the Law Office of Dale A. Burrows, P.C. understand the technical aspects of DWI. When warranted, we can often pre-empt or dispose of DWI charges by challenging the legality and validity of the initial traffic stop and your arrest.  Find the answers to some DWI FAQs.
