Matrimonial law is the area of jurisprudence that focuses solely on the laws governing marriage.  Divorce and legal separation are two common areas of matrimonial law.  To understand which, if either, is right for you it is important to understand the difference in the two.

Divorce vs. Legal Separation

Divorce is the dissolution of a marriage.  In the state of Texas a divorce can be granted on the grounds of: insupportability, cruelty, adultery, conviction of a felony, abandonment, living apart and confinement to mental hospital.  A divorce should only be sought if there is no hope for reconciliation.  All martial assets will be divided during the divorce.  Matters such as custody and spousal and child support will be determined as well.

Legal Separation, in most states, is similar to a divorce as all property, owned or acquired during the marriage, is divided.  Matters such as custody and spousal support are dealt with during the legal separation as well.  However, legal separation is not recognized by the state of Texas.  If you are seeking a legal separation in Lewisville or Coppell and surrounding cities, you and your spouse may prepare a separation agreement or a property partition.  Though the agreement will not be signed by a judge, it can still be considered an enforceable contract.

Your matrimonial attorney will help you determine whether divorce or legal separation is in your best interest.  An experienced matrimonial lawyer will also be able to help you understand your rights and choose the most effective course of action in your case.
