What to Expect During Mediation

 

Mediation Process: 

Prior to the day of mediation, we encourage attorneys to provide us with relevant pleadings, a spreadsheet for any proposals for property division and a confidential statement regarding their client’s position.  This provides the Mediator with necessary case information and helps keep the mediation process moving in an efficient manner. After arriving at our centrally located Flower Mound office or logging in to the Zoom link provided,  the Mediator will speak with each “room” privately to cover the basic process and important mediation house rules.  After the initial meeting, the Mediator will “shuttle” back and forth between the rooms using their negotiation skills and extensive Denton and Collin County family law experience to relay offers and assist in settlement between the two rooms.  The parties may reach agreement on all, some, or none of the pending issues. Water, coffee and light refreshments will be provided. If you are scheduled for a full day mediation, a working lunch will be provided. 

The terms of the Mediated Settlement Agreement are drafted by the Mediator then reviewed, approved, signed and filed with the Court.  That irrevocable document will serve as a template for the drafting of the Agreed Order done later by the attorneys on the case.  At the conclusion of the session, the Mediator will submit a Mediator’s Report to the Court only stating whether the parties reached an agreement or if they were unable to reach an agreement (“Impasse”). 

 

Facilities:

Our centrally located Flower Mound office allows for the parties to attend mediation at a neutral location that was designed for your client’s comfort and safety during the process.  A welcoming space with options for separate entrances and waiting areas can help reduce tension. Our experienced Mediators play a key role by setting clear ground rules, maintaining impartiality, and ensuring confidentiality. We practice shuttle mediation—where each party and their attorney will be located in separate rooms and have access to their own entrance, exit and restroom facilities during the day. Physical comfort also matters: good lighting, comfortable seating, and calming decor contribute to a supportive atmosphere. By prioritizing both physical and emotional security, mediation becomes a process where both parties can feel respected, heard, and empowered to make thoughtful decisions, leading to more durable and cooperative outcomes in your divorce or modification process.
