A will can identify beneficiaries, direct the distribution of covered property, nominate an executor, and nominate guardians for minor children. A pour-over will directs certain remaining assets into an established trust, although those assets may still pass through probate, the court-supervised process for administering an estate.

Trust Planning

A trust holds and manages assets under written instructions. We handle revocable living trusts, which can generally be amended during the creator’s lifetime, and irrevocable trusts, which generally impose greater limits on later changes. The Texas Estates Code governs many aspects of probate and estate administration. Depending on jurisdiction and court assignment, a Denton County case may proceed through Probate Court No. 1 or Probate Court No. 2. Administration can involve validating a will, appointing a personal representative, gathering assets, addressing debts, and distributing the remaining property.

Not every asset passes under a will. Life insurance, retirement accounts, payable-on-death accounts, and jointly owned property may transfer according to beneficiary or ownership provisions.
